Sonesta Travel Pass Terms and Conditions
1. General and Definitions
1.1
Sonesta Travel Pass membership and its benefits are offered at the sole discretion of Sonesta International Hotels Corporation (“Sonesta”). All interpretations of the Sonesta Travel Pass program (“Program”) shall be at the sole discretion of Sonesta. Sonesta reserves the right to terminate, modify, revise, or change, in whole or in part, the Program, the Program’s Terms and Conditions, benefits, rewards, membership tier qualifications, inventory and/or availability of rewards at any time, with or without notice. Furthermore, the membership of participating hotels in the Program as well as partner affiliations may change at any time without prior notice. Changes may result in a reduction in the value of benefits or points already accumulated and may also result in forfeiture of unused points.
1.2
Enrollment in the Program is complimentary and is available to individuals residing in countries that legally permit participation in frequent stay programs. Each individual may maintain only one Membership and no joint accounts are permitted. Membership in the Sonesta Travel Pass program is void if prohibited by law in the country of the member or applicant’s residency.
1.3
Members must be at least 18 years of age or the age to sign a binding contract in the state or province of residence, whichever is older. As sign up for the Program takes place online, you may be required to provide personal identification with your date of birth in order to verify age upon check-in at a property.
1.4
Sonesta reserves the right to discontinue Sonesta Travel Pass membership and/or remove points for any member who appears to be using the Program in a manner inconsistent with these Terms and Conditions, in Sonesta’s sole discretion. Sonesta also reserves the right to discontinue membership:
a. For any member who engages in unruly behavior or conduct unbecoming of a guest of a Sonesta hotel or resort,
b. For any member who acts in a manner inconsistent with local, state, provincial, or federal laws, statutes or ordinances,
c. If Member has enrolled as a company and/or other entity, as only individuals are permitted to enroll in the program,
d. For Member’s failure to provide and maintain valid contact information,
e. For any failure to pay hotel charges and/or any expenses incurred during a Member’s stay, including if such failure to pay is the result of a Member’s check being returned for insufficient funds, chargeback on a Member’s credit card, or payment being invalid for any reason at any time. Upon Sonesta’s cancelation of your membership, cancellation will be effective immediately. Sonesta will provide notice to you at the contact information you provided. Sonesta is not responsible for the failure of any notification to reach Member if Member has not provided Sonesta with valid, updated contact information.
1.5
Sonesta Travel Pass membership is for the sole use of that member and is non-transferable.
1.6
With respect to printing or production errors, Sonesta reserves the right, without limitation, to correct any Program offers, letters, e-mails, benefits, or points. Sonesta reserves the right to correct any point, reward, stay, or benefit granted in error.
1.7
Members are required to update Sonesta with any changes to personal information that could affect their membership. Profile access is available on Sonesta’s Web site at Sonesta.com, where members can make changes to their profile information and check their reward point balance. Members may also contact the Sonesta Travel Pass Customer Care center at 1.855.622.2160 (toll-free in U.S.) or at 1.617.658.0078.
1.8
Respecting your privacy is important for us, and you may review the Sonesta Privacy Policy on Sonesta.com. Sonesta may from time to time send you certain Program information that may include, but is not limited to, marketing materials which will inform you of special offers and products we believe may be of interest to you. You will be given the opportunity to opt-out from receiving these marketing materials.
1.9
Members also authorize Sonesta to share your account information with subsidiaries and third parties, such as Program partners and technology service providers in order to service your Membership account and to facilitate the booking and processing of reservations.
1.10
A “Qualified Rate” can include but is not limited to retail rates (Best Available Rate and Packages*), Consortia, Negotiated Corporate, Extended Stay, and Government. A Qualifying Rate may also include specific discount rates such as advance purchase, length-of-stay offers, AAA/CAA, 55+, and discounts available on Sonesta.com and/or via Sonesta International Reservations. *Qualifying Rate/Packages include the portion of the rate attributed to the guest room price and excludes other package elements and taxes.
1.11
A “Non-Qualified Rate” can include but is not limited to 3rd Party Internet (opaque discount sites such as Priceline & Hotwire and merchant sites such as Booking.com, Expedia, Hotels.com, Orbitz & Travelocity), Contract, Wholesale (tour operators and FIT), voucher, barter, Sonesta Business Rates, Reward Stays and special promotions on 3rd Party internet sites.
1.12
A “Qualified Room Night” is an overnight stay where the reservation is in the Program member’s name, includes the member’s Sonesta Travel Pass ID number and is booked and paid for at a Qualified Rate.
1.13
A “Qualifying Year” is defined as any calendar year in which the member was both a registered and active member.
1.14
“Qualified Room Revenue” is defined as revenue derived from the rental of rooms and suites at qualifying rates, excluding taxes and fees.
2. Membership Tiers
2.1
The membership tiers are awarded based on the number of Qualified Room Nights accumulated by a specific member within a Qualifying Year. Once the qualification of a membership tier has been reached, that status will be granted and maintained for the remainder of the calendar year as well as the subsequent year.
2.2 The membership benefit tiers of the Program are defined as follows:
2.2.1
The “Bronze” tier status is awarded for zero (0) to nine (9) Qualified Room Nights within the same Qualifying Year OR a qualifying point balance of 0 to 9,999 points.
2.2.2
The “Silver” tier status is awarded for ten (10) to nineteen (19) Qualified Room Nights within the same Qualifying Year OR a qualifying point balance of 10,000 to 19,999 points. “Silver” tier members are also eligible to earn 50% bonus points on Qualified Room Nights.
2.2.3
The “Gold” tier status is awarded for twenty (20) to thirty-nine (39) or more Qualified Room Nights within the same Qualifying Year OR a qualifying point balance of 20,000 to 39,999 points. “Gold” tier members are also eligible to earn 75% bonus points on Qualified Room Nights.
2.2.4
The “Platinum” tier status is awarded for forty (40) or more Qualified Room Nights within the same Qualifying Year OR a qualifying point balance 40,000 points or more. “Platinum” tier members are also eligible to earn 100% bonus points on Qualified Room Nights.
3. Sonesta Travel Pass Benefits
3.1
Sonesta Travel Pass member benefits are provided for the Member's room.
3.2
At participating Sonesta locations, members may receive upgrades to preferred room types, which may include the next-best available room type booked. Upgrades may also include rooms with desirable views, corner rooms, rooms on high floors, rooms with special amenities, or suites as identified by each property.
3.3
Room upgrades are subject to availability at time of check-in.
3.4
Benefits are provided only to Sonesta Travel Pass members during their stay and are not redeemable for cash.
3.5
Benefits and services offered by participating hotels may vary.
3.6
Participating hotels attempt to provide benefits and services in accordance with personal preferences indicated in the member's online profile (such as room type, room location, and bed type). However, all benefits and services are subject to availability and are not guaranteed.
3.7
Where available, Sonesta Travel Pass members will be upgraded to the premium tier of internet access for free. The premium tier provides additional bandwidth and allows for use of up to 7 devices. This complimentary premium high-speed internet access applies to daily in-room usage and is not applicable to in-room television Internet service, hotel work centers or group and meeting space. Sonesta Travel Pass members must be registered guests to receive complimentary premium high-speed internet access. Internet connection may not be available at some international hotels. A one-hour internet access card per stay will be issued for qualifying members to use the internet when staying on board the Sonesta Nile Cruises and Red Sea resorts.
3.8
The complimentary continental breakfast benefit entitles the member to receive a voucher or credit for complimentary continental breakfast at participating Sonesta outlets. Complimentary breakfast benefit may vary by brand.
3.9
The availability of the discounted suite upgrade is at the discretion of the hotel at the time of check-in.
3.10
Sonesta Travel Pass benefits are only provided on Qualified Room Nights and Qualified Reward Nights.
3.11
Reward Points are awarded and redeemable at participating hotels. Reward Points are currently available at The Royal Sonesta Hotels, Sonesta Hotels & Resorts, The James Hotels, Classico: A Sonesta Collection, Mod: A Sonesta Collection, Sonesta ES Suites, Sonesta Simply Suites, Sonesta Select, Sonesta Essential, Red Lion Hotels, Signature Inn, America’s Best Value Inn, Canada’s Best Value Inn, Sonesta Posadas del Inca, in the following locations: United States, Puerto Rico, Canada, Chile, Colombia, Ecuador, Peru, and St. Maarten.
4. Earning Reward Points and Qualified Room Night Credit
4.1
Points and Qualified Room Night credit may be earned only upon completing both an actual stay and payment for that stay. Points and Qualified Room Night credits are not awarded for no-shows even if the room is paid for in full. Members only earn one (1) Qualified Room Night credit, per member, per night for up to five (5) consecutive Qualified Room Nights per stay, towards Sonesta Travel Pass member tier status regardless of the number of concurrent reservations booked and paid for by the member.
A Member is eligible to receive Reward Points for staying at participating Sonesta hotels for his/her room and up to two additional rooms. Member’s Sonesta Travel Pass ID Number must be on the reservation AT TIME OF CHECK-IN OR BEFORE to be eligible. Furthermore, all rooms must be reserved and registered in the member's name, include the member’s Sonesta Travel Pass ID Number on all reservations and the member must pay for all rooms, which payment arrangement must be requested at time of hotel check-in. The member must also stay in one of the rooms. Except for a one-time adjustment which may be granted as set forth in Section 4.6, no points will be awarded if member’s Sonesta Travel Pass ID Number is not on the reservation on or before the day of check-in, even if member is currently staying at the property.
If payment is reversed for any reason, then points and credits will not be awarded, and if points or credits have already been awarded, such awards will be reversed.
4.2
Reward Points are awarded for Qualifying Room Nights at participating hotels. Participating Sonesta hotels currently include U.S., Puerto Rico, Canada, Chile, Colombia, Ecuador, Peru, and St. Maarten Sonesta locations only. A qualified stay must have a check out date after the day the hotel began participating in the Sonesta Travel Pass program.
Ten (10) Reward Points will be awarded for each U.S. dollar of Qualified Room Revenue – exclusive of taxes and other fees where applicable at The Royal Sonesta Hotels, Sonesta Hotels & Resorts, The James Hotels, Classico: A Sonesta Collection, Mod: A Sonesta Collection, Sonesta ES Suites, Red Lion Hotels. Five (5) Reward Points will be awarded at Sonesta Simply Suites, Signature Inns, America’s Best Value Inns, and Canada’s Best Value Inns for each U.S. dollar of Qualified Room Revenue – exclusive of taxes and other fees where applicable.
4.3
Only the member whose name and Sonesta Travel Pass ID are listed as the primary guest on the reservation will receive Sonesta Travel Pass benefits for the qualified stay. For the avoidance of doubt, if more than one Member stays in a room, only one of the Members will be awarded Points and/or benefits, as long as all other conditions for such award of points and/or benefits are satisfied. The Sonesta Travel Pass ID cannot be changed by another Member after the first night has been consumed.
4.4
Eligibility for Elite Tier Bonus Points begins on the next qualified stay occurring after the member has achieved the applicable tier. The amount of Bonus Points a member earns will depend on the Member’s achieved Elite member tier pursuant to Section 2.2. For the purpose of this section 4.4, “Elite” tier means either Silver, Gold, or Platinum tier.
4.5
Members may not accrue more than 100,000 reward points per stay per room, including up to two (2) additional rooms during a stay. A stay is defined as one night or consecutive nights per room at the same hotel, regardless of frequency of check-in/check-out.
4.6
Members may receive credit for Qualified stays 30 days prior to enrollment, if requested within 60 days of enrollment. Contact the Sonesta Travel Pass Customer Care center at 1.855.622.2160 (toll-free in U.S.) or 1.617.658.0078.
4.7
Members who do not engage in eligibility activity for 24 months will be re-classified as “Non-Active.” Eligibility activity includes accruing or redeeming Rewards Points and accruing a Qualified Room Night. Sonesta Travel Pass may extend active member status in its sole discretion.
4.8
All Rewards Points expire after 24 months of inactivity from the date of their issuance.
5. Sonesta World Mastercard®
5.1
Sonesta World Mastercard® credit card accounts are currently issued only to U.S. residents by Bank of America, N.A. Neither Sonesta International Hotels Corporation, nor any parent, affiliate, or subsidiary of Sonesta International Hotels Corporation, issue the Sonesta World Mastercard® credit card. Sonesta World Mastercard credit card accounts are subject to credit approval and an annual fee. Restrictions and limitations apply. For more information on the Sonesta World Mastercard® program, visit bofa.com/sonesta. Bank of America will mail you Rewards Program Rules containing additional card rewards program terms once your credit card account is established.
5.2
Sonesta World Mastercard® cardholders may be offered additional methods to earn points in the Program. The terms and conditions that govern such cardholder offers are provided at or before the time of each eligible offer. To receive or utilize any additional Program benefits offered to Sonesta World Mastercard® cardholders, the cardholder must be a member of the Sonesta Travel Pass program in good standing.
6. Redeeming Reward Points
6.1
Reward Points may be redeemed for Reward Stays at participating hotels by booking direct at Sonesta.com. You may also redeem your points by contacting the Sonesta Travel Pass Customer Care Desk at 1.855.622.2160 (toll-free) or at 1.617.658.0078.
6.2
Profile access is available at Sonesta.com, where members can check their reward point balance.
6.3
Reward nights at The Royal Sonesta Hotels, Sonesta Hotels & Resorts, The James Hotels, Classico: A Sonesta Collection, Mod: A Sonesta Collection Sonesta Select, Sonesta Essential, Red Lion Hotels, Signature Inn, America’s Best Value Inn, Canada’s Best Value Inn, Sonesta Posadas del Inca are for Base Room Types. Base Room Types vary by hotel and are assigned upon check-in. Reward nights at Sonesta ES Suites and Sonesta Simply Suites are for Studio room types where available or One-Bedroom room types when the hotel does not have Studios.
6.4
There are no blackout dates for Reward Nights; however, Reward Nights are subject to current availability on Sonesta.com at the time of reward redemption. A minimum length of stay may apply and/or room inventory may be limited from time to time. Reward night reservations require a credit card to guarantee the reservation.
6.5
Reward Stays are non-transferable, except to immediate family, meaning parent, child, spouse and siblings. Transfer of a Reward Stay must be requested at the time Reward Points are redeemed. Reward Points can be transferred upon completion and submission of a transfer form; contact the Customer Care Desk for assistance. Once the authorization for transfer is received and processed, the transferor relinquishes all rights to the transferred points, and they become the recipient’s points.
6.6
Sonesta Travel Pass Reward Stays and benefits may be subject to income or other taxes. Any taxes and all disclosures are the sole responsibility of the member or reward recipient. Reward Stays are valid for a single or double standard hotel room for up to two adults.
6.7
If a hotel no longer participates in the Reward Points and Reward Stay elements of the Sonesta Travel Pass program, the Customer Care Desk will contact members holding future Reward Stay reservations and assist them with re-booking their Reward Stay at a participating hotel.
7. Miscellaneous
7.1
By redeeming Reward Points and receiving benefits in the Program, you agree that Sonesta and its affiliates and subsidiaries and their respective officers, directors, employees, representatives and agents (collectively, the “Released Parties”) will have no liability or responsibility whatsoever for, and shall be held harmless against, any liability for any injuries, losses, or damages of any kind (including without limitation, direct, indirect, incidental, consequential, or punitive or exemplary damages) to persons, including personal injury or death, or property arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a Reward Point or benefit. In no event shall the Released Parties be liable to you for any delay in or failure to perform due to causes beyond Sonesta’s control, including without limitation, any act of God, act of war, natural, disaster, weather, terrorism, or any act or omission of a third party. This section will survive termination of your participation in the Program.
7.2
This Program and these Terms and Conditions shall be governed by, construed, and interpreted under the laws of the Commonwealth of Massachusetts. The Federal and State courts of the Commonwealth of Massachusetts shall be the exclusive court of jurisdiction in the first instance for any disputes regarding these Terms and Conditions. In any such dispute, under no circumstances will members or participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys’ fees, other than member’s actual out-of-pocket expenses, even if Sonesta has been advised of the possibility of such damages.
7.3
Sonesta provides the Program, these Terms and Conditions, and other services and products “As Is” and, to the fullest extent permitted by applicable law, expressly disclaims any representation or warranties of any kind, express or implied, including but not limited to warranties of merchantability, or fitness for a particular purpose.
7.4
If any mistakes are discovered, your exclusive remedy shall be the issuance of points, or such other alternative comparable benefit as determined by Sonesta. In no event shall Sonesta be liable to any member, or anyone claiming through a member, for any direct, indirect or consequential damages, or lost revenue or profits, arising out of Sonesta’s acts or omissions in connection with the Program.
7.5
Sonesta is not responsible for late, lost, incomplete, or misdirected information or communications; computer system, phone line, electronic equipment, computer hardware, software or program malfunctions, or other errors; failures or delays in computer transmissions or network connections; or for any other technical problems. Sonesta is not responsible for incorrect or inaccurate information, whether caused by members or by any of the equipment or programming associated with or utilized in the Program, or by any technical or human error which may occur in the processing of points and account information. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROGRAM IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SONESTA RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
